Developer settles dispute over defects in Braddon apartment complex

A Canberra developer has paid $2.8 million to settle a legal dispute over the construction of a Braddon apartment complex. The payout – which is understood to include $1.4 million to fix waterproofing defects, structural-steel corrosion and de-bonded masonry – ends more than a decade long battle between builder Michael Koundouris and the owners corporation of the Lagani Apartments.

ANGRY residents were locked out of the Ridges Principal Body Corporate annual general meeting for the second year running yesterday as demands grow about greater transparency for property owners in the subdivision west of Peregian. Inside more than 30 items on the agenda were voted on without discussion and with the chairs of four subsidiary body corporates unable to influence the outcomes due to the weight of numbers in the developer's favour.

NSW: Have Your Say on changes to the Strata Building Bond & Inspections Scheme

The proposed Strata Schemes Management Amendment (Building Defects Scheme) Bill 2018 is now available for public consultation. The proposed amendments seek to enhance the ability of Fair Trading to verify the building contract price (on which the 2% building bond is based), and to clarify the role of the building inspector in the scheme.

NSW: Have Your Say on Short Term Letting

State Member for Sydney, Alex Greenwich, has launched a petition to have short term letting debated in NSW parliament. He needs 10,000 signatures. They must be original signatures so people need to print, sign, and mail/drop off to his office.
We urge NSW LookUpStrata readers to sign, put up in their lobbies, and share with their committees and other lot owners.
Independent MP Alex Greenwich: There has been a strong supportive response to my petition calling for owners corporations the authority to control short term letting in their building, including to place limits beyond state controls or to ban the practice outright. If you support this approach, please sign and collect signatures. Print petition HERE.

Q: Could you please refer me to precedents in relation to "house rules" adopted by body corporate committees for the keeping of animals in apartments.
Todd Garsden, Hynes Legal replied:
A: House rules are 100% unenforceable. Any “rules” need to be adopted into the by-laws or form conditions of any approval sought from the body corporate.
