Hosted by OCN Chair, Jane Hearn, the webinar will cover the use of residential buildings by online rental brokers and the hugely negative impact this can have on residents.
Although short term holiday lettings have decreased due to the pandemic, this is temporary and the demand will be back. Now is the time to decide what you want for your apartment building and your community. Jane will explain proposed changes to the NSW planning system which take away the protection that development conditions, existing by-laws and residential zoning have provided until recently.
The webinar will provide a solution to these issues by explaining a new by-law that is available. The bylaw bans investor/hosts from flipping residential apartments to the tourist market. In the face of a complete de-regulation, OCN mounted a successful campaign for clear legal authority to adopt such by-laws. OCN will also explain how it continues to press for a better outcome to the planning law changes.

We have received this reply from OCN:
Thank you for your question. The Owners Corporation Network of Australia (OCN) campaigned to get the law clarified and enable strata schemes to prevent their apartment blocks turning into quasi hotels. The OCN then commissioned a specialist strata lawyer with experience in overcrowding and short term letting to draft a by-law specifically to implement new section 137A of the Strata Schemes Management Act 2015 (NSW).
The new section 137A commenced 10 April 2020. Please be aware that the usual special resolution procedure applies, as with all by laws. The planning law will not change until later in the year but Government has commenced the by law power ahead of the rest of the framework.
Tomorrow (20 May) OCN is running a free webinar as so many people still do not know that the planning law is changing, and they will need to update their by-laws in line with the new provision.
